  1.                 SOFTWARE LICENSE AGREEMENT OF

  5. JUNGO ("LICENSOR") IS WILLING TO LICENSE THE 
  6. ACCOMPANYING SOFTWARE TO YOU ONLY IF YOU ACCEPT ALL OF 
  7. THE TERMS IN THIS LICENSE AGREEMENT. PLEASE READ THE TERMS 
  8. CAREFULLY BEFORE YOU INSTALL THE SOFTWARE, BECAUSE BY
  9. INSTALLING THE SOFTWARE YOU ARE AGREEING TO BE BOUND BY THE
  10. TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS,
  11. LICENSOR WILL NOT LICENSE THIS SOFTWARE TO YOU, AND IN THAT
  12. CASE YOU SHOULD IMMEDIATELY DELETE ALL COPIES OF THIS
  13. SOFTWARE YOU HAVE IN ANY FORM.

  16. OWNERSHIP OF THE SOFTWARE
  17.  
  18. 1.   The enclosed Licensor software program ("Software") and
  19.   the accompanying written materials are owned by Licensor or
  20.   its suppliers and are protected by United States of America
  21.   copyright laws, by laws of other nations, and by international
  22.   treaties.

  25. GRANT OF LICENSE
  26.  
  27. 2.  Jungo grants to you as an individual, a personal, nonexclusive 
  28.   "one-user" license to use the Software on a single computer in the manner
  29.   provided below at the site for which the license was given. If you are an
  30.   entity, Jungo grants you the right to designate one individual 
  31.   within your organization to have the right to use the Software on a single
  32.   computer in the manner provided below at the site for which the 
  33.   license was given.

  35. 3.   If you have not yet purchased a license to the
  36.   Software, Licensor grants to you the right to use the Software for
  37.   an evaluation period of 30 days.  If you wish to continue using the
  38.   Software and accompanying written materials after the
  39.   evaluation period, you must register the Software by sending
  40.   the required payment to Licensor. You will then receive a
  41.   license for continued use and a registration code that will
  42.   permit you to use the Software on a single computer free of payment
  43.   reminders.
  44.   The Software may come with extra programs and features that
  45.   are available for use only to registered users through the
  46.   use of their registration code.

  49. RESTRICTIONS ON USE AND TRANSFER
  50.  
  51. 4.   You may not distribute any of the headers or source files which are 
  52.   included in the Software package.
  53.  
  54. 5.   The license for WinDriver allows you for royalty free
  55.   distribution of the following files only when
  56.   complying with sections 5a, 5b, 5c and 5d of this agreement:
  57.   WINDRVR.SYS (Windows NT/98/ME/2000)
  58.   WINDRVR.VXD (Windows 95/98/ME)
  59.   WINDRVR.DLL (Windows CE)
  60.   windrvr.a, linux_wrappers.c, linux_wrappers.h (Linux)
  61.   windrvr (Solaris)
  62.   windrvr.o (VxWorks)
  63.  
  64. 5a.  These files may be distributed only as part of the 
  65.   application you are distributing, and only if they 
  66.   significantly contribute to the functionality of your 
  67.   application.

  69. 5b.  You may not distribute the WinDriver header file (WINDRVR.H). 
  70.   You may not distribute any header file which describes the 
  71.   WinDriver functions, or functions which call the WinDriver 
  72.   functions and have the same basic functionality as the WinDriver
  73.   functions themselves.

  75. 5c.  You may not modify the distributed files specified in section
  76.   5 of this agreement.

  78. 5d.  WinDriver may not be used to develop a development product, 
  79.   an API, or any products which will eventually be part of a development 
  80.   product or environment, without the written consent of the licensor.

  82. 6.   You may make printed copies of the written materials
  83.   accompanying Software provided that they used only by users
  84.   bound by this license.

  86. 7.   You may not distribute or transfer your registration
  87.   code or transfer the rights given by the registration code.
  88.  
  89. 8.   You may not rent or lease the Software or otherwise
  90.   transfer or assign the right to use the Software.
  91.  
  92. 9.   You may not reverse engineer, decompile, or disassemble
  93.   the Software.

  96. DISCLAIMER OF WARRANTY
  97.  
  98. 10.  THIS SOFTWARE AND ITS ACCOMPANYING WRITTEN MATERIALS
  99.   ARE PROVIDED BY LICENSOR "AS IS" AND ANY EXPRESS OR IMPLIED
  100.   WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED
  101.   WARRANTIES OF MERCHANTABILITY,  FITNESS FOR A PARTICULAR
  102.   PURPOSE, AND NON-INFRINGEMENT, ARE  DISCLAIMED.

  104. 11.  IN NO EVENT SHALL LICENSOR OR ITS SUPPLIERS BE LIABLE
  105.   FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR
  106.   CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO,
  107.   PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE,
  108.   DATA, SAVINGS, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER
  109.   CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT,
  110.   STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR
  111.   OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS
  112.   SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
  113.   Because some states do not allow the exclusion or limitation
  114.   of liability for consequential or incidental damages, the
  115.   above limitation may not apply to you.

  117. 12.  This Agreement is governed by the laws of the 
  118.   United States of America.

  135. U.S. GOVERNMENT RESTRICTED RIGHTS
  136.  
  137. 14.  The Software and documentation are provided with
  138.   RESTRICTED RIGHTS. Use, duplication, or disclosure by the
  139.   Government is subject to restrictions set forth in
  140.   subparagraph (c)(1) of The Rights in Technical Data and
  141.   Computer Software clause at DFARS 252.227-7013 or
  142.   subparagraphs (c)(1)(ii) and (2) of Commercial Computer
  143.   Software - Restricted Rights at 48 CFR 52.227-19, as
  144.   applicable.
